CARDINHAM PARISH COUNCIL CLOSED SESSIONS

Where CPC hides its dirty work and unlawful decisions

  1.  CPC holds a lot of closed sessions 
   -  Every month from December 2009 to January 2011.
   -  Dozens of them in the last 7 years 
   
  2.  CPC's Agenda never says what the Closed Session is for  
     
The reasons given, ie:-
Staffing matters” and “publicity would be prejudicial to the public interest by reason of the confidential nature of the business to be transacted”, are meaningless.
   
 

3.  CPC Minutes never report Decisions in Closed sessions. 

          The published minutes have never reported any business CPC
     conducted, or any decisions it resolved, in closed sessions. 
   
  4SEVERY CLOSED SESSION DECISION WAS UNLAWFUL 
          Because for a decision to exist and be lawful it must be:-   
       4.1.  Advertised on the Agenda to be considered by the Council           
       4.2.  Decided by resolution at a lawfully constituted meeting of the Council  
       4.3.  Recorded in the certified  public minutes of the Council
   
 

5.  ACTIONS CPC BASED ON THEM WERE ALSO UNLAWFUL

   
  6.  These actions by CPC over the last 7 years were unlawful.

None of these were publicly advertised, resolved or minuted.)
 

6.1  Trying to take Archie Bonkers Land and Wheelwrights Stone    
        Employing a Solicitor to pursue it.

6.2  Taking Archie Bonker to the Bodmin Small Claims Court to make him pay £72
        for 35  pages of CPC Minutes.

6.3.  Instructing the Clerk to defy the Information Commissioner, thereby getting  
        CPC a criminal Caution.
6.4   Investigating the Clerk regarding the Criminal Caution. 
6.5   Finding the Clerk blameless. 
6.6   Sacking the Clerk. 
6.7   Appointing a new Clerk.
